General Terms and Conditions

These General Terms and Conditions (T&C) set out the terms of renting the EXI Moments mobile hot tub. The tub is let by a private individual trading as EXI Moments; their details are in section 1. By booking, the Renter accepts the T&C, and the rental contract refers to this version.

1. The Lessor

Let as a private individual
The Lessor is neither a company nor a registered sole trader (PFA): they pay tax on the rental income as a private individual in Romania. They are not registered for VAT, so prices contain no VAT. They do not issue invoices (factură); on request they confirm a payment by e-mail.
2. The service
What it includes
The rental of a mobile hot tub (fibreglass liner, wood-fired stove, on a trailer) with the accessories listed in section III of the contract. The Lessor delivers the tub, sets it up, explains how to use it, and collects it at the end of the rental. There is one tub, so only one booking is possible for any period.
Where
Mainly around Miercurea Ciuc, Odorheiu Secuiesc, Gheorgheni and Sovata. The Lessor delivers to other places by prior agreement; see section 4 for the delivery fee.
The Renter’s part
Filling the tub with water and heating it are the Renter’s task; obtaining and paying for water and fuel (firewood or briquettes) is the Renter’s responsibility. Filling takes about 1,000–1,300 litres of clean water on site: mains water, or a well or lake the tub can be filled from.
Separate services
A separate service (for example filling with a pump, when available) is provided only for a price agreed in advance in writing (by e-mail). No other amount may be charged without the Renter’s express consent.
Companies and organisations
A company or organisation may rent too, but must say so before booking: as a private individual the Lessor does not issue invoices, and the tax side then has to be agreed separately.
3. Booking and formation of the contract
Booking steps
- Booking request. The Renter enters the period, the delivery address and their contact details on the website. The request does not yet bind either party.
- Payment request. If the period is free and delivery to the site is possible, the Lessor e-mails the full price (rental price + delivery fee) and the details for transferring the booking fee (section 7). The parties may also agree that the Renter pays the booking fee on site.
- Confirmation – this forms the contract. Once the booking fee has arrived – or without it, if on-site payment was agreed – the Lessor confirms the booking by e-mail. The e-mail states the amounts to pay and attaches the rental contract as a PDF: the Romanian original and, for bookings made in Hungarian or English, its translation.
- Signing. The parties sign the contract at the latest on delivery: online on the Renter’s own device (via the link in the confirmation e-mail), on the Lessor’s device at delivery, or on paper in two copies. When signing, the Renter gives their home address and identifier (a Romanian renter their CNP, a foreign renter their passport or ID card number), because the Lessor must register the contract with the tax authority (section 15).
Contract and T&C
The contract contains the booking details, the prices and the most important rules, and names the applicable version of the T&C. If the two differ, the contract prevails; the provision more favourable to the Renter always applies. The contract: Romanian original · English translation.
Electronic signature
The online signature is a simple electronic signature under Regulation (EU) No 910/2014 (eIDAS) and Romanian Law 214/2024. When a contract is signed electronically we record the time of signing, the IP address and the browser details; we e-mail the contract signed by both parties to the Renter. For a contract signed on paper, the Lessor also keeps a scanned copy of the signed original.
4. Prices and payment
Rental price
Rental prices are shown in the Prices section of the website; the booking form calculates the rental price for the chosen period (with seasonal prices and any last-minute discount). The price calculated at booking is recorded on the booking; a later price change does not affect it.
Delivery fee
Delivery is free within 20 km of Miercurea Ciuc. For places further away the fee is agreed individually; the Lessor gives the full price including the delivery fee already in the payment request (for on-site payment, in the confirmation).
Booking fee
200 lei, which counts toward the total price. Its payment and refund are governed by section 7.
The remaining amount
The difference between the total price (rental price + delivery fee) and the booking fee already paid is due when the service is provided – before delivery or at on-site setup –, in cash or by bank transfer. The bank account is in the confirmation e-mail. Online card payment is not available.
Final prices, deposit
Prices are final, with no VAT (the Lessor is not registered for VAT). The Lessor currently asks for no security deposit. Should a booking need one, the Lessor says so before confirmation, it appears in section IV of the contract, and it is returned within 5 working days of collection if no damage occurred.
5. Delivery, the site and collection
Time
The parties agree the exact delivery and collection times by phone before the start.
The site
The tub must stand on flat, stable ground, in a place the trailer can reach and where the stove’s smoke and heat can escape freely (no branches, roof or other obstacle directly above the tub). After booking, the Renter fills in a short site questionnaire (water, access, ground, draining of used water) and is responsible for the answers being correct.
If the tub cannot be set up
If the tub cannot be set up safely because the site differs from what was stated in the questionnaire, this counts as a cancellation by the Renter, and the booking fee is refunded under section 7 (nothing is refunded on the day of delivery). In any other case where setup is not possible, the Renter gets back all amounts paid.
Handover and collection
At handover and at collection the parties record the condition of the tub, including by photographs. Before collection the Renter drains the water at the place given in the questionnaire, lets the stove cool down and removes the ash; the Lessor then collects the tub.
6. Use and safety
Proper use
The Renter uses the tub with care, following the instructions provided by the Lessor. The Renter is not liable for normal wear and tear.
Not allowed
- moving the tub or handing it over to someone else without the Lessor’s prior consent (which may be given by e-mail);
- letting children use the tub without adult supervision;
- using the stove other than as instructed, or heating the tub empty;
- putting substances or additives in the water without the Lessor’s consent.
Responsibility for guests
The Renter is responsible for the persons they allow to use the tub. For safety, we advise against using the tub under the influence of alcohol or drugs.
7. The booking fee and cancellation by the Renter
The booking fee
The booking fee is 200 lei and counts toward the total price. When paying by transfer, it must arrive within 3 days of the payment-request e-mail; until then the Lessor holds the period for the Renter and may extend the deadline where justified. If the fee does not arrive and the parties have not agreed on on-site payment either, the Lessor may delete the booking request. With on-site payment, the fee is paid after setup, at the latest at collection.
Cancellation
The Renter may cancel the booking at any time by e-mail, or by phone followed by an e-mail confirmation. Of the booking fee paid, the Renter gets back, depending on the calendar days left until the start date:
- at least 14 days: the whole fee (200 lei);
- 7–13 days: half the fee (100 lei);
- 6 days or fewer: nothing.
Example: for a start on 17 October, cancelling by 3 October refunds the whole fee, between 4 and 10 October half of it, and from 11 October nothing. Days are counted in Romanian time.
What else is refunded
If the fee was to be paid on site, it is not owed on cancellation. The Lessor does not charge the rental price on cancellation and refunds in full anything paid beyond the booking fee. The part of the booking fee kept compensates for the blocked period, which is hard to let to someone else.
Refunds
The Lessor confirms the cancellation by e-mail and refunds the amount due within 14 days of the cancellation: a transferred fee to the account it came from, a fee paid in cash in cash or, at the Renter’s request, by transfer. If force majeure (section 8) makes the rental impossible, all amounts paid are refunded.
8. Cancellation and non-performance by the Lessor
Notice
If the Lessor cannot provide the service, they inform the Renter without delay by phone and e-mail.
Force majeure
Force majeure or an unforeseeable, unavoidable event (Art. 1351 of the Romanian Civil Code) includes, for example: an orange or red warning of the Romanian National Meteorological Administration (ANM) under which delivery is not safe; a natural disaster; a road closure; an official ban (including a ban on lighting fires); a sudden, serious and documented illness or accident of the Lessor. In these cases the Renter gets back all amounts paid within 14 days.
Cancellation for another reason
If the Lessor cancels for another reason (for example a technical fault or a double booking) less than 7 days before the start date, the Renter may choose:
- a full refund of the amounts paid plus compensation equal to the booking fee (200 lei); or
- a replacement hot tub from another provider, accepted by the Renter, for the same period at no extra cost to the Renter.
On an earlier cancellation all amounts paid are refunded. The Lessor pays the amounts due within 14 days.
9. Defects at handover and during the rental
The Lessor’s commitment
At handover the tub is clean, working and safe.
If there is a defect
If a defect preventing use appears at handover or during the rental, the Renter informs the Lessor without delay by phone or e-mail – the Lessor can be reached throughout the rental. The Lessor acts within a reasonable time: repairs the defect or, if that is not possible, reduces the price proportionally or refunds the price for the days the tub could not be used. If the tub cannot be used at all from handover, the Renter may terminate the contract and gets back all amounts paid.
10. Delayed collection and damage
Delayed collection
Collection is carried out by the Lessor at the agreed time. If collection is prevented through the Renter’s fault (for example the site is not accessible or the Renter does not allow collection), the Renter owes, for each calendar day started, 50% of the daily rental price, and from the 5th day 100%, not exceeding the Lessor’s actual loss. Example: if the daily rental price is 250 lei, one day of delay costs 125 lei.
Damage
The Renter compensates damage caused to the tub or its accessories by improper use, intentionally or negligently, beyond normal wear and tear (Art. 1350 and 1821–1822 of the Romanian Civil Code). The compensation equals the actual cost of repair or replacement, at most the value listed for each item in section VII of the contract; the Renter may prove that the damage is lower. The current values:
- trailer: 3000 EUR;
- hot tub, total: 3000 EUR, of which the stove 850 EUR, the fibreglass liner and LED electronics 1400 EUR, other accessories (mixing paddle, stove and tub accessories, etc.) 750 EUR.
Values in euro are converted to lei at the BNR rate on the day of the damage. In a dispute the parties may jointly appoint an independent expert; this does not prevent either party from going to court.
11. The Lessor’s liability
Limitation and exceptions
The Lessor’s liability is limited to the amounts paid by the Renter under the contract and does not cover indirect or unforeseeable damage (Art. 1533 of the Romanian Civil Code). This limitation does not apply to damage caused intentionally or through gross negligence, nor to harm to life, bodily integrity or health.
12. Right of withdrawal
No 14-day right of withdrawal
The rental is a leisure service provided on a specific date, so the Renter has no 14-day right of withdrawal (Art. 16(l) of Romanian Emergency Ordinance 34/2014). The booking form points this out, and the Renter acknowledges it when booking. Cancellation is governed by section 7.
13. Complaints and disputes
Complaints to the Lessor
Complaints can be made at hello@exi-moments.ro or on +40 754 638 350; the Lessor replies in writing within 15 days.
Authority and alternative dispute resolution
The Renter may also turn to the Romanian consumer protection authority (ANPC, anpc.ro), including its alternative dispute resolution system (SAL, reclamatiisal.anpc.ro).
Courts
The Renter may also bring proceedings before the court of their own domicile; the Lessor may sue the Renter only before the court of the Renter’s domicile.
14. Governing law and language
Governing law
The contract and the T&C are governed by Romanian law, in particular the Romanian Civil Code (Codul civil).
Language
The contract is concluded in Romanian; a Renter who booked in Hungarian or English receives a translation for information before signing, and in case of any difference the Romanian text of the contract prevails. The T&C are available in Hungarian, Romanian and English with the same content; should they nevertheless differ, the version more favourable to the Renter applies.
15. Personal data and tax registration
Data processing
The Lessor processes personal data in accordance with the Privacy Policy.
Registration with the tax authority
Under a legal obligation, the Lessor registers the contract with the Romanian tax authority (ANAF, form C168) within 30 days of its conclusion. For this, a copy of the contract – with the Renter’s name, home address and identifier – goes to ANAF.
16. Changes to the T&C
Which version applies
A booking is governed by the version in force when it was made; the contract also names it. A later change does not affect bookings already confirmed. The Lessor keeps the earlier versions and sends them on request.
